TERMS AND CONDITIONS

Welcome! We're delighted to have you participate in the COATS® campaign. By participating, you agree to the following terms and conditions:

Eligibility:

This campaign is open to residents of Malaysia and Australia aged 18 and above. Additional countries or regions may be included in the future, with announcements to follow.
Employees of Hartalega Holdings Berhad and its affiliates and subsidiaries (collectively, the "Company", “we”, “us” and “our”), and their immediate families, are not eligible to participate.

How To Participate & Selection of Participants:

Those interested in participating in the campaign are required to complete and submit their personal details. Please note that filling out your personal details does not guarantee participation.
By submitting your personal details, you agree that you have read, understood, and consent to comply with these terms and conditions, along with our Privacy Policy, and acknowledge being fully bound by them.
The Company reserves the right to review all applications, and suitable participants will be selected to participate in the campaign (“selected participants", you" and "your") at our discretion based on pre-determined criteria.
The COATS® gloves will be delivered to selected participants and the selected participants will be contacted for further details on the receipt of their COATS® gloves.
Participants shall use COATS® gloves for participants’ benefit only and shall not use the same for any form of commercial purpose directly or indirectly.
Participants shall use and store the COATS® gloves strictly in accordance with the instructions stated in the product label.

Testimonial Submission:

In exchange for receiving the COATS® gloves, participants agree to submit a testimonial about their experience using the product.
All participants will be asked to submit a simple testimonial after using the gloves.
Some selected participants may be contacted by the Company to participate in a more extensive video testimonial. Participation in the video testimonial is voluntary and separate from the initial submission.

Testimonial Usage:

By participating, you hereby grant the Company the right to use any testimonials, photos, or videos submitted during the campaign for advertising and promotional purposes. This includes use on the Company’s website, social media channels, newsletters, marketing materials, and other materials as deemed necessary.
You further agree that the Company may also use the testimonials for our own promotional purposes, including extending the usage of the testimonials in any form to the Company's customers for their promotional usage via their official social media channels, website, and other promotional materials.
You hereby agree that the Company owns all rights to the submitted content and may edit or modify it for use.
You have the right to withdraw your testimonial at any time by contacting us via email at givecoatsgloves@hartalega.com.my. We endeavor to review and respond to your request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. The response we provide will also explain the reasons we cannot comply with your request, if applicable.
In the event you withdraw your testimony previously provided to the Company, the Company may agree to cease using the testimonials for future promotional purposes. However, the Company shall not be required to remove or alter any testimonials that have already been uploaded, shared, or otherwise made public prior to the withdrawal of testimony.

Data Protection and Privacy Policy:

We value your trust in us and will collect your personal details solely for administering the COATS® gloves campaign and contacting you regarding your testimonial as confidential.

We hereby declare that we do not have any hidden purposes, other than those described, for using your information.
The Company will engage a third-party agent to manage the campaign and coordinating the stage of live testimonials. The third-party agent shall have access to all necessary information, subject to confidentiality and data protection measures and will be responsible for contacting participants for the live testimonials. The Company acknowledges the third-party agent's involvement is essential for the successful execution of the campaign and agrees to provide them with all relevant support and information required for the campaign.

Intellectual Property:

We are the sole owner of all intellectual property related to our COATS® gloves and campaign, and we reserve all rights. All materials and samples are protected under intellectual property laws worldwide.
You are permitted to use the COATS® gloves as advertised and explained, but redistribution or modification of any materials is strictly prohibited. COATS@ gloves is the intellectual property of the Company, and you are prohibited from copying or imitating it, in whole or in part.
You retain ownership of any creative content you submit (e.g., photos, videos). However, by submitting your content, you grant The Company and its affiliates and subsidiaries an exclusive, non-transferable, royalty-free licence to use, reproduce, modify, publish, and distribute your testimonial in all media platforms and for advertising, commercial and promotional activities.

This campaign and these Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any actions, disputes, causes of action or claims arising out of or in connection with this terms and conditions shall be subject to the exclusive jurisdiction of the courts located in Malaysia.

Additional Information:

The Company reserves the right to change, suspend or cancel the COATS® campaign at any time without prior notice and without any liability to the Participants.
Participants agree to comply with all terms and conditions of the COATS® campaign.
The Company reserves the right to disqualify any participant found tampering with the application process or engaging in any unfair or unethical practices and activities.

Child Protection:

We are committed to protecting the privacy and well-being of children. This COATS® campaign is intended for adults 18 years of age or older. Testimonials from minors cannot be accepted without verifiable parental consent.

Indemnification

You agree to indemnify and hold harmless the Company from and against any and all claims, demands, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with your participation in the COATS® Campaign or your breach of these Terms and Conditions.

Disclaimer of Liability

To the largest extend permitted by Laws, the Company makes no warranty or representation, either expressed or implied, as to the merchantability, fitness for a particular purpose, design, condition, durability, capacity, material or workmanship or as to patent infringement and assumes no liability for any issue arising from or exacerbated by the use of the COATS® gloves, including but not limited to pre-existing skin conditions. Participants acknowledge and accept the inherent risks associated with glove usage.

COATS® CAMPAIGN: CARE WITH EVERY WEAR
PRIVACY NOTICE

Purpose: The aim of this COATS® campaign is to gather testimonials of participants’ hand skin condition and to gauge the efficacy of our products (i.e., COATS® gloves) in alleviating the participant’s symptoms or conditions (“Testimony”). We collect your personal data with your explicit consent for the purpose of participating in the COATS® campaign and to analyse the results and testimonials of this Campaign.

INTRODUCTION TO THIS NOTICE

This Privacy Notice ("Notice") explains how Hartalega Holdings Berhad, and its affiliates and subsidiaries (“Hartalega”, “we”, “us” and “our”) collect, share and use any information that, alone or in combination with other information, relates to you ("Personal Data") in your capacity as participant to the campaign ("you" and "your"), conducted by us.

As an entity duly incorporated in Malaysia, the Personal Data Protection Act 2010 of Malaysia (“Act”) shall govern and regulates this Notice and the processing of personal data in the context of the campaign. To the fullest extent compatible with the Act, we comply with the EU General Data Protection Regulation (GDPR), EU-US Privacy Shield Framework and any other applicable data protection laws, including the Australia PDPA and Germany PDPA.

We use the Personal Data collected through the campaign and studies in a de-identified aggregate form to administer the COATS® campaign and contact you regarding your testimonial.

If your Personal Data has been collected, used, or disclosed by us in a particular jurisdiction which has specific requirements or exceptions to the definition of Personal Data, including sensitive Personal Data, we will comply with those requirements under the applicable data protection regulations in that jurisdiction.

This Notice also sets out the rights that you have in relation to the Personal Data that we process about you and how you can exercise them.

By continuing with the Campaign and providing us with your Personal data, you are giving consent for us to collect, use and process your Personal Data in accordance with this Notice.

By continuing with the Campaign and providing us your Sensitive Personal data, you are giving explicit consent for us to collect, use and process your Sensitive Personal Data in accordance with this Notice.

Specifically, the information we collect automatically may include information such as your IP address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location) and other technical information.

Collecting this information enables us to better understand the behaviour of campaign participants, where they come from, and what content on our website is of interest to them. We may use this information for our internal analytics purposes.

The types of Personal Data we collect from third parties include testimonies from participants, responses to surveys or studies, analyses, reports and statistics and we use this Personal Data we receive from these third parties to collect, generate and disseminate information.

You further agree that the Company may also use the testimonials for our own promotional purposes, including extending the usage of the testimonials in any form to the Company's customers for their promotional usage via their official social media channels, website, and other promotional materials.

To the extent that you have provided (or will provide) Personal Data about your family, spouse and/or other dependents, you confirm that you have explained to them that their Personal Data will be provided to, and processed by, us and you represent and warrant that you have obtained their consent to the processing (including disclosure and transfer) of their Personal Data in accordance with this Policy and, in respect of minors (i.e. individuals under 18 years of age) or individuals not legally competent to give consent, you confirm that they have appointed you to act for them, to consent on their behalf to the processing (including disclosure and transfer) of their Personal Data in accordance with this Notice.

DISCLOSURES / ONWARD TRANSFERS OF PERSONAL DATA

Besides the exchange of Data between Hartalega entities, we may disclose your Personal Data to the following categories of Affiliates:

i.	to our third-party researchers and third-party partners for purposes consistent with this Notice. Such researchers analyse the results and draw up a report or publication about such results;
ii.	to our third-party agents, consultants, vendors and services providers who provide data processing services to us, or who otherwise process Personal Data for purposes that are described in this Notice or notified to you when we collect your Personal Data. This may include disclosures to third party vendors and other service providers we use in connection with the campaign including to support us in areas such as execution of campaign, online survey providers IT platform management or support services, infrastructure and application services, data analytics;
iii.	to any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;
iv.	to our auditors, advisors, legal representatives and similar agents in connection with the advisory services they provide to us for legitimate purposes and under contractual prohibition of using Personal Data for any other purpose.

DATA INTEGRITY, PURPOSE LIMITATION AND RETENTION

We will process Personal Data in accordance with this Notice and in compliance with the following principles:

i.	Fairness: We will process Personal Data fairly. This means that we are transparent about how we process Personal Data and that we will process it in accordance with the Act.
ii.	Purpose limitation: We will process Personal Data for specified and lawful purposes and will not process it in a manner that is incompatible with those purposes.
iii.	Proportionality: We will process Personal Data in a way that is proportionate to the purposes which the processing is intended to achieve.
iv.	Data accuracy: We take appropriate measures to ensure that the Personal Data that we hold is accurate, complete and, where necessary, kept up to date. However, it is also your responsibility to ensure that your Personal Data is kept as accurate, complete, and current as possible by informing us of any changes or errors, using the contact below.
v.	Data security: We use appropriate technical and organisational measures to protect the Personal Data that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your Personal Data. Specific measures we use include storing data on a server with restricted access.
vi.	Data processors: We may engage third parties to process Personal Data for and on our behalf. We require such data processors to process Personal Data and act strictly on our instructions and to take appropriate steps to ensure that Personal Data remains protected.
vii.	International data transfers: Your Personal Data may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country and, in some cases, may not be as protective. However, we have taken appropriate safeguards to require that your Personal Data will remain protected in accordance with this Notice.
viii.	Data Retention: We retain your Personal Data where we have an ongoing legitimate need to do so.

We also may disclose Personal Data for other purposes or to other third parties when a Data Subject has consented to or requested such disclosure or under the following circumstances:

i.	we respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;
ii.	we reasonably believe it is necessary to share information in order to investigate or prevent fraud, or to take action regarding illegal activities, situations involving potential threats to the physical safety of any person, or as otherwise required by law;
iii.	We transfer information about you if Hartalega is acquired by or merged with another company. In this event, we will notify you before information about you is transferred and becomes subject to a separate privacy notice.

Please be aware that in rare situations, it may be necessary to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

We shall not process Personal Data in a way that is incompatible with the purposes for which it has been collected or subsequently authorized by the individual. To that end, we will take reasonable steps to ensure that Personal Data is reliable for its intended use, accurate, complete, and current. We use reasonable efforts to maintain the accuracy and integrity of Personal Data and to update it as appropriate.

When we have no ongoing legitimate need to process your Personal Data, we will either delete or anonymized it or, if this is not possible (for example, because your Personal Data has been stored in backup archives), then we will securely store your Personal Data and isolate it from any further processing until deletion is possible.

Hartalega implemented physical and technical safeguards to protect Personal Data from loss, misuse, and unauthorized access, disclosure, alternation, or destruction. For example, electronically stored Personal Data is stored on a secure network with firewall protection, and access to our electronic information systems requires user authentication via password or similar means. Hartalega also employs access restrictions, limiting the scope of employees who have access to Customer Personal Data. Despite these precautions and security measurement taken, no data security safeguards guarantee 100% security all the time.

FOR INDIVIDUALS OUTSIDE MALAYSIA

We recognize that individuals residing outside Malaysia have the right to limit the use and disclosure of their Personal Data, and we are committed to respecting those rights. We offer individuals the opportunity to opt out of disclosures of Personal Data to a third party or the use of Personal Data for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized by the individual. We will endeavor to comply with the GDPR, EU-US Privacy Shield Framework or any other applicable privacy laws in such jurisdiction of the individual (to the fullest extend as compatible with the Act) with respect to disclosures of Sensitive Personal Data including, when applicable, obtaining the explicit consent (i.e. opt in consent) of an individual prior to disclosing Sensitive Data to a third party or using Sensitive Personal Data for purposes other than those for which it was originally collected or subsequently authorized by the individual. In the event of any inconsistencies, conflicts of laws, the provisions under the Act shall prevail.

For Individuals in Australia: In accordance with the Privacy Act 1988 (cth), consent is hereby expressly given to Hartalega including its subsidiaries- Mun Australia to use written testimonies, photographs, images, audio recordings, video recordings and those individuals who is camera shy, re-enactment would be done of the individuals during the campaign, for the purposes of marketing and promotion; advertising; media publicity; publication including in print and digital media formats such as print publications, prospectuses, brochures, web-sites, e-marketing, posters, banners, social media; general display; for before and after comparison purposes; research purposes and for any other commercial purpose Hartalega deems fit and shall have the right to edit, modify, crop, add to or subtract from the photographs, images, audio recordings, video recordings at its sole discretion and without the individual’s further approval.

For Individuals in United Kingdom: In accordance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR), consent is hereby expressly given to Hartalega including its subsidiaries to use written testimonies, photographs, images, audio recordings, video recordings and those individuals who is camera shy, re-enactment would be done of the individuals during the campaign, for the purposes of marketing and promotion; advertising; media publicity; publication including in print and digital media formats such as print publications, prospectuses, brochures, web-sites, e-marketing, posters, banners, social media; general display; for before and after comparison purposes; research purposes and for any other commercial purpose Hartalega deems fit and shall have the right to edit, modify, crop, add to or subtract from the photographs, images, audio recordings, video recordings at its sole discretion and without the individual’s further approval.

In the event of any conflict between the English version and versions in other languages, the English version shall prevail. Hartalega shall have the right to modify, update, or amend the terms of this Policy at any time by placing the updated Policy on its Website. Continuing communication or participation of the COATS® Campaign shall signify your acceptance of the Policy, unless you inform us otherwise.

This Policy supplements and does not supersede or replace any other consents you may have previously provided to us in respect of your Personal Data. This Policy also does not affect any rights that any member of the Hartalega may have in law in connection with the collection, use, or disclosure of your Personal Data.

RIGHT TO ACCESS, CHANGE OR DELETE PERSONAL DATA

You have the right to obtain confirmation about whether Personal Data is included about them in our databases. Upon request, we will provide an individual access to his or her Personal Data within the time frame dictated by the applicable data protection regulations:

i.	In addition, in certain circumstances, as stipulated in the applicable data protection legislation, you can object to the processing of your Personal Data, ask us to restrict processing of your Personal Data or request portability of your Personal Data.
ii.	If we have collected and processed your Personal Data with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your Personal Data conducted in reliance on lawful processing grounds other than consent.
iii.	If you have a complaint or concern about how we are processing your Personal Data, then we will endeavor to address such concern(s). If you feel we have not sufficiently addressed your complaint or concern, you have the right to complain to a data protection authority about our collection and use of your Personal Data. We endeavor to respond to a verifiable request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. The response we provide will also explain the reasons we cannot comply with a verifiable request, if applicable. Any disclosures we provide will only cover the 12-month period preceding receipt of a verifiable request.

AMENDMENTS TO THIS NOTICE

We may update or amend this Notice from time to time in response to changing legal or technical developments and in such case, we will take appropriate measures to inform you, consistent with the significance of the changes we make. We will obtain your consent to any material Notice changes if and where this is required by applicable data protection laws.

GOVERNING LAW

This campaign and the Privacy Notice are governed by and construed in accordance with the laws of Malaysia. Should there be any discrepancies between the data protection laws in any of the jurisdiction, then the Malaysia data protection laws shall prevail.
